1. Pre-Charter Health Declaration

By signing this document, I confirm that:

☐ I am in good general health and physically capable of boarding, moving about, and evacuating the yacht
☐ I do not suffer from conditions that would be worsened by: motion sickness, sun exposure, heat, salt water contact, or time at sea
☐ I am not pregnant or suffer from pregnancy-related complications that could be affected by sea conditions
☐ I am not under the influence of alcohol or illegal drugs
☐ I do not have a fear of water or confined spaces that could impact my safety aboard
☐ I understand that medical facilities on Mallorca may be 30–60 minutes away by boat
☐ I accept responsibility for any medical conditions and their management while at sea

Declaration: I understand that if I am unwell or have undisclosed health conditions, I may be denied boarding without refund. Honesty about health ensures everyone's safety.

2. Acknowledgment of Risks

I acknowledge and understand the following risks associated with yacht charter:

2.1 Maritime & Environmental Risks

☐ Sea conditions: Wave motion, wind, and sea swell may cause discomfort or motion sickness
☐ Weather: Unexpected weather changes; potential for postponement or early return to port
☐ Sun exposure: Risk of sunburn, dehydration, or heat exhaustion despite sun protection
☐ Water contact: Risk of slipping when wet; cold water temperature (varies by season)
☐ Marine wildlife: Encounters with fish, jellyfish, sea urchins, or other marine life
☐ Engine/equipment noise: Diesel engine operation may be loud; hearing protection available on request
☐ Confined spaces: Yacht cabins are compact; some guests may experience claustrophobia

2.2 Personal Injury Risks

☐ Slipping, tripping, falling: Decks can be slippery; cabins are low-ceilinged with narrow passageways
☐ Impact injuries: Moving vessel may cause loss of balance; sudden manoeuvres may cause injury
☐ Rope/line hazards: Risk of entanglement in sailing rigging or mooring lines
☐ Equipment operation: Any unauthorised operation of yacht controls or equipment could result in injury

2.3 Evacuation & Emergency Risks

☐ I understand evacuation procedures and that life jackets must be worn during mandatory drills
☐ In extreme emergencies, rescue operations may take 30+ minutes; rescue is provided by professional maritime services, not the yacht crew
☐ I accept the risks associated with emergency evacuation (motion, cold water, stress)

2.4 Limitation of Crew Rescue Capability

☐ The crew is trained in basic first aid, not emergency medicine
☐ The crew cannot perform rescues if visibility is poor or sea conditions are severe
☐ I understand that the crew's primary responsibility is yacht safety and navigation, not individual guest monitoring

By checking the boxes above, I acknowledge full understanding of these risks and accept them as inherent to yacht charter.

3. Waiver of Liability

3.1 I Hereby Release

I, the undersigned, hereby release, waive, and discharge Yours Mallorca, the vessel owner, the captain, crew members, and any associated companies from liability for:

Personal injury, death, or disability
Property damage or loss (including personal belongings)
Psychological or emotional distress
Any medical expenses incurred
Loss of enjoyment or missed opportunities
Any other loss or claim arising from my participation in this yacht charter

3.2 Assumption of Risk

I assume full responsibility for all risks inherent to yacht charter, including those listed in Section 2 above, whether foreseeable or not.

I understand that the crew cannot monitor every guest at all times, and I am responsible for my own safety and that of any minors under my supervision.

3.3 Medical Treatment Authorisation

In the event of medical emergency, I authorise the crew to:

Seek emergency medical assistance on my behalf
Share relevant medical information with maritime rescue services
Authorise helicopter evacuation if necessary (at my expense)

I understand that emergency medical services and evacuation may incur significant costs not covered by the yacht charter fee.

4. Code of Conduct & House Rules

By booking this charter, I agree to comply with all house rules and conduct policies:

4.1 Prohibited Behaviour

I will not:

☐ Bring illegal drugs, weapons, explosives, or prohibited items aboard
☐ Engage in violent, aggressive, abusive, or harassing behaviour toward crew or other guests
☐ Damage, deface, or vandalise the yacht or equipment
☐ Operate the yacht, engines, or any vessel systems without explicit permission and training
☐ Exceed the maximum passenger capacity or allow unauthorised persons aboard
☐ Bring animals aboard except registered service animals
☐ Consume excessive alcohol or engage in intoxicated behaviour that poses safety risks
☐ Smoke inside the cabin (deck smoking only, designated areas)
☐ Use audio/music equipment after 22:00 hours at volumes that disturb others
☐ Dive or snorkel from the yacht without crew permission and guidance
☐ Dispose of waste (including toiletries, diapers, or garbage) overboard
☐ Disclose the yacht's location, guest information, or images online without permission (privacy protection for all guests)

4.2 Compliance with Crew Instructions

I agree to:

Follow all safety briefing instructions provided by the crew
Wear a life jacket at all times on deck during unfavourable conditions
Remain seated when the yacht is moving or in rough conditions
Report any injuries or health concerns to the crew immediately
Respect the privacy of crew members; crew quarters are off-limits
Treat all crew members with respect and professionalism
Clean up after myself and respect shared spaces

4.3 Violation of Rules

I understand that violation of any of the above rules may result in:

Immediate termination of the charter
No refund of charter fees or deposits
Liability for damage caused by my actions
Legal action and criminal charges (if applicable)
Banning from future charters

5. Security Deposit & Damage Waiver

5.1 Security Deposit

A security deposit of €1,000 is held during the charter and refunded within 7 days of completion, minus any deductions for:

Damage caused by guest negligence (repairs charged at cost)
Excessive cleaning beyond normal end-of-charter cleaning (€100–€500 depending on severity)
Theft or loss of onboard items (replacement cost charged)
Fuel consumption exceeding normal cruising limits (overage charged at €500/50L)

Multi-day charters also include a €500 fuel deposit, refunded if fuel usage is within normal parameters.

5.2 Damage Assessment

☐ I acknowledge that I have inspected the yacht's condition before departure
☐ I understand that any damage occurring during the charter may be charged against my security deposit
☐ I agree that damage assessments conducted by the crew are final and binding
☐ I will not dispute reasonable charges for damage or excess cleaning within 7 days of charter completion

5.3 Special Equipment & Add-Ons

Seabob water sports package: €250/day

6. Guest Responsibilities & Supervision

6.1 Minors & Children

☐ All guests under 18 must be supervised by a responsible adult at all times
☐ Children under 5 should wear an approved life jacket at all times on deck
☐ Parents/guardians assume full responsibility for children's safety and behaviour
☐ The crew is not responsible for childcare; supervision is the parent/guardian's responsibility

6.2 Group Accountability

If I am the booking contact for a group, I acknowledge that I am responsible for ensuring all guests comply with these terms, safety rules, and conduct policies.

9. Cancellation & Force Majeure Acknowledgment

12. Disclaimer

This document does not override Spanish maritime law or your statutory consumer rights. However, it does express your understanding of the risks and your voluntary assumption of liability for injuries or damages.

If you do not agree with all terms in this document, you may cancel your charter booking up to 14 days before the charter date for a partial refund of your deposit (minus cancellation fees per Terms & Conditions).
