1. Introduction

These Terms & Conditions ("Terms") govern your use of www.yours.luxe and your booking of yacht charter services with Yours Mallorca ("we", "us", "our", "Company").

By accessing our website or completing a charter booking, you agree to be bound by these Terms. If you do not agree, please do not use our services.


2. About Our Services

Yours Mallorca provides luxury private yacht charters of the Tempest 44 motor yacht based at Puerto Portals Marina, Mallorca, Spain.

Our services include:

  • Half-day charters
  • Full-day charters
  • Multi-day cruises
  • Captain hire (optional)
  • Water sports packages (Seabob, jet skis, etc.)
  • Bespoke itinerary planning

All charters are subject to availability and prevailing weather conditions.


3. Booking & Confirmation

3.1 Reservation Process

  1. Submit a booking inquiry via our website with your preferred dates and requirements
  2. Our team confirms availability and sends you a detailed quote
  3. A signed Charter Agreement and invoice are provided
  4. A 30% deposit is due to secure your booking
  5. Final confirmation is issued once deposit is received

3.2 Completion of Booking

Your booking is confirmed only upon:

  • Receipt of your signed Charter Agreement
  • Receipt of the 30% deposit payment
  • Verification of guest suitability and safety requirements

We reserve the right to refuse any booking at our discretion.


4. Payment Terms

4.1 Pricing

Pricing varies by season:

  • High Season (May–October): Premium rates apply
  • Low Season (November-April): Standard rates apply

All prices are quoted in Euros (€) and are subject to change until booking confirmation.

4.2 Payment Schedule

  • Deposit: 30% due at booking confirmation (non-refundable after 14 days, see Cancellation Policy)
  • Balance: 70% due 7 days before your charter date
  • Cash on Arrival: Captain hire, water sports, and fuel surcharges may be payable at embarkation

4.3 Payment Methods

We accept:

  • Credit/debit cards (Visa, Mastercard, American Express)
  • Bank transfer
  • PayPal

All payments are processed securely. Invoices are issued immediately upon payment.

4.4 Taxes & Fees

All quoted prices include Spanish VAT (IVA) unless otherwise stated. No additional taxes or fees apply.


5. Cancellation & Refund Policy

5.1 Cancellation by Guest

  • More than 60 days before charter: 30% deposit refunded (minus 5% admin fee)
  • 30–60 days before charter: 30% deposit non-refundable; balance refunded in full
  • Less than 30 days before charter: Full payment (30% + 70% balance) non-refundable
  • 7 days or less: No refund; loss of full booking amount

5.2 Cancellation by Yours Mallorca

We may cancel a booking if:

  • Severe weather or maritime safety concerns make the charter unsafe
  • The vessel becomes unavailable due to emergency repair or maintenance
  • The booking violates our terms or policies
  • Guest behaviour creates safety or liability risks

In case of cancellation by us, a full refund of all payments will be issued.

5.3 Charter Postponement

If you request to reschedule your charter to an alternative date within the same season, the deposit is transferable without penalty (subject to availability).


6. Guest Responsibilities & Conduct

6.1 Age & Capacity

  • Guests must be at least 18 years old
  • Maximum 10 guests plus crew (2 permanent crew on vessel)
  • Guests under 18 must be accompanied by a responsible adult

6.2 Health & Safety

Guests confirm they are in good health and physically capable of boarding and enjoying the yacht. We recommend travel/health insurance.

Guests with mobility concerns should notify us in advance so we can assess feasibility.

6.3 Prohibited Behaviour

Guests agree not to:

  • Bring illegal drugs, weapons, or prohibited substances aboard
  • Engage in dangerous, violent, or harassing behaviour
  • Damage the vessel or equipment
  • Exceed safe speed limits or navigate outside designated areas
  • Operate the yacht without permission and proper certification
  • Bring unauthorised animals (except registered service animals)
  • Smoke inside the cabin (deck smoking only, approved areas)

Violation of these terms may result in immediate charter termination with no refund.

6.4 Alcohol Policy

Guests may bring their own alcohol or purchase on board. We recommend responsible consumption. The crew reserves the right to intervene if guest intoxication poses a safety risk.

6.5 House Rules

  • Shoes are removed when boarding the yacht (interior cleanliness)
  • Respect crew privacy; crew quarters are off-limits
  • Follow all safety briefing instructions provided by the crew
  • No loud music after 22:00 hours
  • Guests are responsible for returning the yacht in the condition they received it


7. Liability & Insurance

7.1 Waiver of Liability

By booking, guests assume all risks associated with yacht charter, including but not limited to:

  • Sea sickness, seasickness, or motion-related discomfort
  • Exposure to sun, wind, salt water, or marine conditions
  • Slipping, falling, or other accidents on deck or in the water
  • Marine wildlife encounters

Guests agree to release Yours Mallorca, our crew, and vessel owners from liability for personal injury, death, or property damage arising from these risks.

7.2 Insurance

We carry comprehensive yacht liability insurance. Guests are strongly advised to purchase personal travel/holiday insurance covering:

  • Trip cancellation
  • Medical emergency and repatriation
  • Personal accident and injury
  • Loss of luggage or personal belongings

Insurance does not cover us for losses due to guest negligence.

7.3 Security Deposits

A €1,000 security deposit is held during the charter to cover:

  • Damage to the vessel or equipment caused by guest negligence
  • Cleaning beyond normal end-of-charter cleaning
  • Theft or loss of onboard items

The deposit is refunded in full within 7 days of charter completion (minus deductions for damage, if applicable).

Multi-day charters also require a €500 fuel deposit, refunded if fuel usage is within normal parameters.


8. What's Included & Excluded

8.1 Included in Your Charter

  • Use of the Tempest 44 vessel
  • Professional crew (captain and deckhand/chef)
  • Basic refreshments and welcome drinks
  • Safety equipment and briefing
  • Standard navigation and mooring fees
  • Use of onboard amenities (sound system, water sports equipment where applicable)
  • Fuel (within normal cruising limits)

8.2 Not Included

  • Alcoholic beverages (unless pre-arranged and paid separately)
  • Premium catering or meals (beyond basic welcome)
  • Water sports equipment rentals (e.g., Seabob rental available at €250/day)
  • Captain hire for navigation/yacht operation (€175 half-day; €350 full-day)
  • Docking fees at certain premium marinas
  • Travel to/from the vessel
  • Personal travel insurance (highly recommended)


9. Weather & Force Majeure

9.1 Weather Conditions

We monitor weather forecasts and maritime conditions. If dangerous weather is predicted:

  • We may postpone the charter to an alternative date
  • A full refund or credit toward a future charter will be issued
  • No cancellation penalty applies

9.2 Force Majeure

We are not liable for losses or delays due to:

  • Severe weather, storms, or rough seas
  • War, terrorism, pandemic, or government restrictions
  • Equipment failure or mechanical breakdown
  • Port closures or maritime emergencies
  • Acts of God or circumstances beyond reasonable control

In such cases, we will offer to reschedule or provide a full refund.


10. Complaints & Dispute Resolution

10.1 During Your Charter

If you experience any issues during your charter, please inform the crew immediately. We will make every effort to resolve concerns on site.

10.2 After Your Charter

To lodge a formal complaint:

  1. Email us within 7 days of charter completion at charter@yours.luxe
  2. Include charter dates, specific issues, and requested resolution
  3. We will respond with our findings within 14 days

10.3 Dispute Resolution

If you are unsatisfied with our response:

  • We offer mediation through a neutral third party
  • Disputes are governed by Spanish law and the laws of Mallorca
  • The parties agree to attempt negotiation before pursuing legal action


11. Intellectual Property

All content on www.yours.luxe (text, images, videos, branding) is the property of Yours Mallorca and protected by copyright law.

You may not reproduce, distribute, or use our content without explicit written permission.


12. Website Use

12.1 Limited License

We grant you a non-exclusive, limited license to use our website for lawful purposes only.

12.2 Prohibited Activities

You agree not to:

  • Scrape, crawl, or harvest content from our website
  • Engage in any form of hacking or unauthorised access
  • Post spam, malware, or harmful content
  • Impersonate another user or organisation
  • Violate any applicable laws or regulations

12.3 Disclaimer

Our website is provided "as is" without warranties of any kind. We do not guarantee:

  • Uninterrupted website availability
  • Accuracy of all information (while we strive for accuracy)
  • Compatibility with all devices or browsers

We are not liable for losses resulting from website downtime or errors.


13. Modifications to Terms

We may update these Terms at any time. Changes take effect immediately upon posting.

Your continued use of our website or services constitutes acceptance of updated Terms.

We recommend reviewing this page periodically for changes.


14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect.


15. Entire Agreement

These Terms, combined with our Charter Agreement, Privacy Policy, and Cookie Policy, constitute the entire agreement between you and Yours Mallorca regarding yacht charter services.

By booking a charter with Yours Mallorca, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.

Effective from June 2026. All bookings made from this date forward are subject to these Terms.
